Where that vacancy occurs more than ten (10) days before the end of the 2020 election filing period specified by North Carolina law, the Governor shall call for a special primary for the purpose of nominating candidates to be voted on in a special election and shall fix the dates in which the filing period will occur and on which the special primary and general elections are to be held.1 You must visit the county board of elections where you are registered to vote and request the county board of elections chair or the county board of elections director to sign the certificate of affiliation on a notice of candidacy form. The certification states the candidate’s party and affirms that the candidate has not changed party affiliation in the past 90 days. The filing period for the 2019 Special Election for House District 3 begins at 8:00 a.m. on Monday, March 4, 2019 and ends at 5:00 p.m. on Friday, March 8, 2019. 4) What must I bring to file? • Notice of candidacy form3 • A check for the filing fee: $1,740.00 4 5) Where do I file? • State Board of Elections, 3rd floor of Dobbs Building, 430 N. Salisbury St., Raleigh, NC • Parking: visitors may park in Dec #75, a block south of the Dobbs Building on Salisbury Street. Drivers passing the Dobbs Building (gray building on the left as one heads south on Salisbury Street from Peace Street) will note the State Capitol Police office building on the right, after which is an historic red brick building. The parking deck is immediately after the red brick building. 6) May I mail the notice of candidacy and filing fee? Yes, if you have the notice of candidacy form properly notarized, you may mail it or have it delivered by commercial courier or presented to the State Board by a surrogate. State Board of Elections mailing address: P O BOX 27255, Raleigh, NC 27611-7255. Notice of candidacy and filing fee must be received at the State Board offices before the filing deadline regardless of the time the mailing was deposited or postmarked. If a notice of candidacy and filing fee are not received at the State Board offices by the filing deadline, the candidate has missed the opportunity to file. NOTE: Any United States Postal Service mail that is addressed to our physical address is automatically diverted to our post office address, which builds in a delay on receipt. State Board of Elections mailing address: P O BOX 27255, Raleigh, NC 27611-7255 Given the shortness of the filing period, it is strongly recommended that candidates who are unable to appear to file in person direct their filing material to the State Board offices at our physical address by a courier service or have form and check delivered by a surrogate. 7) Ensure that your information is properly entered on the notice of candidacy form: • You must use your legal name or a nickname by which you have been known for five years prior to filing. o If you wish to use a nickname you must provide a signed affidavit that you have been known by that nickname for at least five years o You may sign with the nickname of affidavit in lieu of legal first name and any middle initial or name, but your legal last name is required. o No nickname is permitted that will mislead voters as to your status or unduly advertise the candidacy. • No title or appellation indicating rank, status or position is permitted. 8) Election Dates for 2019: • Primary: Tuesday, April 30, 2019 • Second primary. If a second primary is required because no candidate receives thirty percent (30%) of the primary vote in the first primary, the second primary will occur on Tuesday, July 9, 2019.5 • General election: The special general election is Tuesday, July 9, 2019, unless a second primary is required. In the event a second primary is required, the special general election shall be held on Tuesday, September 10, 2019. 9) Qualifications of Candidates for U.S. House6 • 25 years of age or older by the date of the general election • A U.S. citizen for at least 7 years • A resident of the state when elected (a candidate running for U.S. House is not required to be a resident of the congressional district in which the candidate is seeking election) • A registered voter of the state. 7 10) What action is required for a person to have his or her name entered on the ballot for the primary election? Typically, a person seeking office pays a filing fee and files a notice of candidacy during the filing period. • Form to file. Each candidate must file a notice of candidacy8 form with the North Carolina State Board of Elections. This form is available under the caption “Candidate Forms” on this page of our agency’s website: https://www.ncsbe.gov/Elections/Candidate-Filing. • Party affiliation. A candidate must be a registered voter affiliated with the same political party in which he or she intends to file. A person changing party affiliation must do so more than 90 days prior to the date the candidate files.9 • Felony record. The notice of candidacy form includes questions about any felony convictions of the candidate; if there are any convictions, additional information is required on a separate form within 48 hours of submitting the notice of candidacy. Art. I §2 12) Single Office Contest. No one may file for more than one office in the same election (with exceptions for elections to fill vacancies for US Senate or US House).13 13) What are the campaign reporting requirements? Campaign reporting requirements for candidates to Congress are provided by the Federal Election Campaign Act of 1971, P.L. 92-225, as amended (Title 252, U.S.C. Chapter 301). Candidates for Congress should contact the Federal Election Commission (FEC) for requirements for registering a campaign finance committee.
